Children Under the Age of 16

Our Website is not intended for children under 16 years of age. No one under age 16 may provide any personal information to the Website. We do not knowingly collect personal information from children under 16. We do not sell any personal information we collect or use, except as described in the Special U.S. Privacy Information section below. We may transfer to and store the personal information we collect in countries other than the country in which the personal information was originally collected, including the United States, Canada or other destinations. Those countries may not have the same data protection laws as the country in which you provided the personal information. When we transfer your personal information to other countries, we will protect the personal information as described in this policy and comply with applicable legal requirements.

We also share information about your use of the Website with our social media, advertising and analytics service providers for these purposes. We strive to provide you with choices regarding the personal information you provide to us.

To the extent required under applicable law, we will facilitate individual rights to confirm whether we process personal information from you and if we do, to request access to personal information, correct inaccurate personal information, delete personal information, restrict processing of personal information, receive personal information, and transmit this data to another data controller without hindrance. We may not accommodate a request if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the Website, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Website users.

Information We Collect

Some of the information we collect information constitutes “personal information” under the California Consumer Privacy Act of 2018 (“CCPA”) and the California Privacy Rights Act of 2020 (“CPRA”) or “personal data” under the Virginia Consumer Data Protection Act (“VCDPA”), the Colorado Privacy Act (“ColoPA”), the Connecticut Act Concerning Personal Data Privacy and Online Monitoring (“CTDPA”), Utah Consumer Privacy Act (“UCPA”), or other similar state laws. All such information is referred to as “personal information” herein.

In particular, within the last twelve (12) months, we collected (whether directly, indirectly (e.g., by observing your actions on the Website) or from third parties) the categories of personal, which constitute “personal information” under the CCPA and CPRA or “personal data” under the VCDPA, ColoPA, CTDPA, UCPA or other similar state laws, listed in the table below. Any such collection has been for of the purposes included in the appropriate section of the How We Use and Disclose Your Information section above.

For the purposes of this Section, “personal information” does not include publicly available information from government records, lawfully obtained, truthful information that is a matter of public concern, deidentified or aggregated consumer information or information specifically excluded from the scope of applicable data protection laws, such as health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data or other biomedical research study or personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), the Federal Farm Credit Act of 1971, and the Driver’s Privacy Protection Act of 1994.

We do not collect any information of consumers that constitutes “sensitive personal information” under the CCPA and CPRA or “sensitive data” under the VCDPA, ColoPA, CTDPA, or UCPA (collectively, “Sensitive Data”). Further, we do not sell any Sensitive Data of consumers, and we do not share any Sensitive Data of consumers with third parties for cross-context behavioral advertising or process any Sensitive Data of consumer for purposes of targeted advertising.

We obtain the categories of personal information listed in the table above from the following categories of sources:

• Directly from you when you provide it to us or our third party service providers, such as when you sign up for an account on our Website;
• Automatically as you navigate through the Website or mobile application. Information collected automatically may include usage details, IP addresses, city/state/country location, and information collected through cookies, web beacons, and other tracking technologies;
• Our Chat Tool on our Website; and
• From third parties, for example, our business partners.

Disclosing Personal Information for a Business Purpose

DriveCentric may disclose consumers’ personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter into a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

In the preceding twelve (12) months, DriveCentric has disclosed the following categories of personal information for a business purpose:

Category A: Identifiers.

Category B: California Customer Records personal information categories.

Category C. Protected classification characteristics under California or federal law.

Category F: Internet or other similar network activity.

We disclose consumers’ personal information for a business purpose to the following categories of third parties:

• To our affiliates and subsidiaries;
• To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them. These service providers include, but are not limited to,
  • Dealership Management Systems,
  • Credit Approval Systems,
  • Dealer Marketing Companies,
  • Appraisal Software Companies,
  • Automotive OEMs, and
  • Social Media Companies;
• With advertisers, advertising- and marketing-related services providers and partners as well as companies that help us learn how you and others interact with our content;
• To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about users of our website is among the assets transferred; and
• To third parties (other than our affiliates and subsidiaries) to market their products or services to you if you have not opted out of these disclosures. We contractually require these third parties to keep personal information confidential and use it only for the purposes for which we disclose it to them.

Sales of Personal Information

We may also “sell” consumers’ personal information to third parties, subject to the right to opt-out of those sales. As used herein, “sell” is used as defined in applicable law, such as the CPRA, VCDPA, ColoPA, CTDPA, and UCPA. Our personal information sales do not include information about individuals we know are under age 16. We sell personal information for the purposes listed in the How We Use Your Information section above.

In the preceding twelve (12) months, we have sold the following categories of personal information:

1. Identifiers.
2. California Customer Records personal information categories.
3. Protected classification characteristics under California or federal law.

We sell the above categories of personal information to the following categories of third parties:

• Dealership Management Systems and

Your Rights and Choices

As applicable, certain state privacy laws, such as the CCPA, CPRA, ColoPA, VCDPA, CTDPA, and UCPA provide their residents, respectively, with specific rights regarding their personal information. This subsection describes these rights and explains how those residents can exercise those rights.

Access to Specific Information and Data Portability Rights

You have the right to request that we certain information to you about our collection and use of your personal information. Once we receive and verify your request (see Exercising Access, Data Portability, Correction, and Deletion Rights below), we will disclose to you:

• The categories of personal information we collected about you.
• The categories of sources for the personal information we collected about you.
• Our business or commercial purpose for collecting or selling that personal information.
• The categories of third parties with whom we disclose that personal information.
• The specific pieces of personal information we collected about you (also called a data portability request).
• If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
  • the personal information categories that we sold and for each category identified, the categories of third parties to whom we sold that particular category of personal information; and
  • the personal information categories that we disclosed for a business purpose and for each category identified, the categories of third parties to whom we disclosed that particular category of personal information.

Correct Specific Information.

You may have the right to request that we correct inaccurate personal information about you. Once we receive and verify your request (see Exercising Access, Data Portability, Correction, and Deletion Rights below), we will use commercially reasonable efforts to correct the information to comply with your request. This right is not afforded to residents of Utah.

Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and verify your request (see Exercising Access, Data Portability, and Deletion Rights below), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. In responding to your request, we will inform you whether or not we have complied with the request, and, if we have not complied, provide you with an explanation as to why.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

• Complete the transaction for which we collected the personal information, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
• Help to ensure security and integrity to the extent the use of your personal information is reasonably necessary and proportionate for those purposes.
• Debug products to identify and repair errors that impair existing intended functionality.
• Exercise free speech, ensure the right of another consumer to exercise that consumer’s free speech rights, or exercise another right provided for by law.
• Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
• Engage in public or peer-reviewed scientific, historical, or statistical research that conforms or adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the ability to complete such research, if you previously provided informed consent.
• Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us and compatible with the context in which you provided the information.
• Comply with a legal obligation.

When you use a request method above, we will request certain information for verification purposes, such as your name, address, and e-mail address. We will use this information to verify this is a permitted request, such as by matching your name and address with information in our records. Depending on the type of request, we may require a certain number of data points to allow for verification.

Only you, a person authorized by you to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

An authorized agent may make a request on your behalf using the request methods designated above. Additionally, if you use an authorized agent to submit a consumer request, we may require the authorized agent to provide proof that you gave the agent signed permission to submit the request. We may also require you to verify your own identity directly with us or directly confirm with us that you provided the authorized agent permission to submit the request.

You may only make a consumer request for access or data portability twice within a 12-month period. The request must:

• Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized agent of such person.
• Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account.

We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

If we deny your request, you may have the right to appeal our decision. Further, if you appeal and your appeal is denied, you may the right to complain to your state’s attorney general. You may appeal your decision by contacting us at info@drivecentric.com.

Response Timing and Format

In accordance with applicable law, we endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 45 additional days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Personal Information Sales Opt-Out and Opt-In Rights 

Pursuant to applicable law, you have the right to direct us to not sell your personal information at any time (the “right to opt-out”). We do not have actual knowledge that we sell or share the personal information of consumers under 16 years of age. We will not sell the personal information of consumers we actually know are less than 16 years old, unless we receive affirmative authorization (the “right to opt-in”) from either the consumer who is at least 13 and less than 16 years old, or the parent or guardian of a consumer less than 13 years old. Consumers who opt-in to personal information sales may opt-out of future sales at any time. To exercise the right to opt-out, you (or your authorized representative) may submit a request to us by visiting the following Internet Web page link: 

 Do Not Sell My Personal Information 

You may also exercise the right to opt-out using an opt-out preference signal in a format commonly used and recognized by businesses, such as through an HTTP header field. When we receive an opt-out preference signal, we will treat it as a valid request to opt-out of the sale or sharing for that browser or device sending the signal, and, if known, for the consumer.

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. Non-Discrimination

We will not discriminate against you for exercising any of your rights under applicable law. Unless permitted by applicable law, we will not:

• Deny you goods or services.
• Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
• Provide you a different level or quality of goods or services.
• Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by applicable law that can result in different prices, rates, or quality levels. Any legally-permitted financial incentive we offer will reasonably relate to the value to us of your personal information and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
